EP approves the revised Posting Directive |
The formal vote in the Council will take place in June and the Member States will then have 2 years to implement the new provisions.
Will the new Directive effectively introduce substantive improvement, as many are claiming ?
Probably not in the construction industry (which represents 43% of postings) :
- controls for the application of the principle of “equal pay for equal work in the same place” will need significant political will and resources
- the maximum duration of 12+6 months will only concern a small share of construction worksites (the vast majority of which lasts for 3-4 months on average)
- the provisions related to travel and lodging allowances mainly transpose into the directive the existing rulings of the European Court of Justice
- the differences in social security contributions have not been addressed, as they are covered by other EU legislations.

Industry manifesto on digitalisation
Several European associations representing different professions in the construction value chain have pledged to collaborate to transform the industry. In a joint manifesto “Smarter Construction, Stronger Economy, Inclusive Society” the co-signatories stress the need for co-operation between the main industry players and other relevant sectors, in particular the IT industry. The manifesto also asks EU policy makers to take the political lead and provide an appropriate regulatory framework on data policy and financial framework for the skills, research and development and IT infrastructure that are all necessary to make the widespread implementation of digital construction a reality.
